1. Acceptance of Terms

By downloading, installing, or using Node Playground ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Node Playground ("we," "us," or "our") regarding your use of the App.

2. Description of Service

Node Playground is an interactive visualization application that creates immersive experiences through node-based visualizations. The App allows users to:

• Create and interact with dynamic node networks
• Experience visual effects and animations
• Use touch and tilt-based controls
• Customize sound and visual settings

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple device that you own or control, solely for your personal, non-commercial purposes.

Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any commercial purpose without our written consent
• Remove or alter any proprietary notices or labels on the App

4. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Node Playground, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to interfere with or disrupt the integrity or performance of the App
• Attempt to gain unauthorized access to the App or its related systems
• Use any robot, spider, or other automatic device to access the App

6. Updates and Modifications

We may from time to time develop and provide App updates, which may include upgrades, bug fixes, patches, and other error corrections and/or new features (collectively "Updates"). Updates may also modify or delete in their entirety certain features and functionality.

You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features or functionality.

7. Third-Party Services

The App may display, include, or make available third-party content or provide links to third-party services (including the Apple App Store). We are not responsible for any third-party content or services, and your use of such content and services is at your own risk.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NODE PLAYGROUND, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

10. Indemnification

You agree to defend, indemnify, and hold harmless Node Playground and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in the United States, and you hereby consent to the personal jurisdiction and venue therein.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
